Difference between 'Bare Rental' and 'Operated & Maintained' (O&M) liability?
Bare rental transfers liability to the customer who provides operator and maintenance. O&M keeps liability with rental company who provides certified operator.
In bare rental agreements, the customer assumes primary liability for crane operations, accidents, and damages. The rental company provides only the equipment, while the customer supplies the operator, fuel, maintenance, and assumes responsibility for proper operation. This arrangement typically results in lower rental rates but exposes the customer to significant liability risks including property damage, personal injury, and operational errors.
